Thank you for using the SOL Distro Site and services features we make available to You (collectively, the “Service”). In the context of using the Service it is required to process information concerning users (« User »). To use the various services offered by the Service, the User transmits information, some of which identifies him or her ("Personal Data"). The present privacy policy informs the User of the manner in which We collect and processes User’s Personal Data. We attach particular importance to data security, confidentiality, privacy and related rights. Please take the time to read our Privacy Policy carefully.

By providing Us with Your personal data or other information on the Site or by subscribing to the Service, or by entering into a contract with Us, You expressly acknowledge that You have read and agree to abide by this Privacy Policy. Minors (as defined in many countries) may not subscribe to the Service or the Site without the prior consent and authorization of their parent(s) or legal guardian(s) and the latter's acceptance of this Privacy Policy. We reserve the right to modify this Privacy Policy at any time.

The data controller is Makerverse Tech (PTY) LTD, a South African company company (registration number: 2024/548279/07), located at Unit No 106, Kingshaven Estate, 1011 Otto Du Plessis Drive, 7441 South Africa (hereinafter referred Your use of the Service is subject to these TOS (when you accept them, these terms constitute the "Agreement").

Purpose of data processing

We use the data collected to :

  • Comply with Our contractual obligations

  • Create and manage User’s personal account;

  • Perform Our contractual obligations;

  • Provide the Services purchased;

  • Carry out various payment transactions;

  • Respond to User questions, requests for information or manage and improve customer service;

  • Provide, enhance, personalize and optimize User’s customer experience and facilitate sharing functions on social networks;

  • Communicate with User (for administrative, promotional or commercial purposes);

  • Implement, ensure and improve the security of the Site and Service, combat fraud, and prevent Data security breaches as defined RGPD ;

  • Analyze, identify, improve and understand the operation of the Site and Service and trends in the use of the Sites and Services;

  • Determine, personalize and adapt the effectiveness of promotional and advertising marketing techniques to User uses and needs;

  • Manage and administer User’s Personal Data in compliance with the GDPR.

Legal basis for processing User’s data

We only collect and process the User's Personal Data in the cases provided for by the regulations in force:

  • The performance of the Agreement concluded between Us and a User for the use of the Service (Article 6,1, b) of the General Data Protection Regulation of April 27, 2016)

  • The consent given by the User to the use of his/her data (Article 6,1, a) of the General Data Protection Regulation of April 27, 2016)

  • The existence of a legitimate interest for SOL Distro to use the User's data. Legitimate interest is a set of commercial or business reasons that justifies SOL Distro's use of the User's personal (Article 6,1, f) of the General Data Protection Regulation of April 27, 2016)

  • A legal obligation.

Processed data

We process Personal Data that the User communicates to it such as:

  • Surname and first name(s) ;

  • Postal address (billing or delivery) ;

  • Landline or cell phone number (personal or business) ;

  • E-mail address;

  • Banking information (bank and bank account, other bank account information, account or bank identification numbers, credit/payment card information, expiry date, visual cryptogram);

  • Passport or identity document number;

  • Spoken languages or languages of use of the Site;

  • Any personal/confidential information to help User remember his/her personal login and password;

  • For Minors, their parents or their legal representative, their surname, first name(s) and e-mail address;

  • For artists or their representatives only : the stage name, textual, graphic, photographic or videographic elements, or sound and dates, associated with a phonogram reproducing the performance by an artist (hereinafter "Recording") or with videograms reproducing an audiovisual work produced by fixing images intended to illustrate the performance of a musical work that is the subject of a Recording (hereinafter "Videomusic"); cover art, lyrics, videograms, titles of works (compositions with or without lyrics), names, stage names, pseudonyms, biographies, videos and photos of artists, names of songs and albums and associated artists, the year of release of songs and albums and the name of the person(s) or entity that holds the rights to the songs, albums, arrangements and/or illustrations; the metadata necessary to identify the works fixed on the Recordings and Videomusic, and their rightful owners, in particular the names of the authors, composers, publishers, ISWC codes of the works, the names of any rightful owners, ISRC codes, UPC codes... in the case of registration for Services requiring the collection of such information : tax identification number;

  • IP address (number automatically assigned by User’s Internet Service Provider or the MAC address of his/her electronic devices from which access to the Site is made and which are automatically identified and recorded each time the Site(s) is/are used); Demographic data on Users (e.g. age, gender, place of residence);

  • Data on Users' tastes, musical preferences (playlists) or other shared data collected from music platforms;

  • Technical information such as cookies (for more information, see our Cookie Management Policy);

  • Geographical location data, in particular via GPS signals sent by mobile telephony devices: when Users use the geolocation services offered by the Sites, for example to offer them personalized advertising, We will first obtain their express authorization (opt-in). In this case, Users may withdraw their consent at any time (opt-out);

We process data collected through cookies and other tracking devices.

How do we collect User’s Data

We collect User’s Data in the following ways:

  • The contract User has signed with Us;

  • The account User has created or the Service User has subscribed to.

  • The consultation, downloading or use of the Site;

  • User's orders;

  • User's complaint about a Service and/or the Site

  • User’s subscription to newsletters or other communications;

  • Browsers, devices, widgets and other digital applications on these devices;

  • Server log files;

  • Cookies;

  • Geolocation when Users have given us their express consent;

Who are the recipients of User’s Personal Data Purpose of data processing

The Data that User directly or indirectly transmits to Us is accessible exclusively by duly authorized persons when this is necessary for the sole purposes detailed above. We ensure that such access complies with the security measures We have put in place

The Data Recipients may be:

  • Our subsidiaries ;

  • Third-party service providers with whom We work to facilitate the provision of the Services or access to the Site (hosting services, data analysis, processing of payment transactions and royalties, etc…);

  • For artists or their representatives only: the information provided may be used to track how certain albums and/or songs are selling in the charts. By using Our Services they agree that We may provide information relating to the sale of Recordings or Videomusic to third parties (DSP).

  • We may also communicate User’s Data to duly authorized persons, only when this as ? is necessary for the sole purposes set out above, in the following cases: To comply with current legislation, including that of countries other than User’s country of residence;

  • To respond to injunctions or requests from public or governmental authorities, including those of public or governmental authorities based in countries other than User’s country of residence;

  • To perform or enforce the Agreement or the TOS & DTOS of Our Services, or to protect Our activities or those of Our subsidiaries or those of Our artists, labels, managers and producers;

  • To protect Our rights, safety or property or Our subsidiaries or artists, labels, managers or producers;

  • To establish, exercise or defend Our legal rights;

  • To take any necessary action or limit the damages and any other condemnations that may be imposed on Us or its subsidiaries;

  • In the event of a reorganization, merger, acquisition, joint venture or any other form of transfer of all or part of SOL Distro or its assets to the third parties in question; In the event of transfers of specific Data after obtaining User’s consent;

  • To protect User or third parties against fraud, abuse, illegal acts or violations of the terms and conditions of use of the sites or services or sale of products;

How long do we keep User’s Data

We retain User’s Data only for as long as is necessary to perform the Agreement, to achieve the purpose of the Service, or to meet User’s needs or Our legal obligations.

The Data retention criteria that We have put in place include the following:

  • The duration of the contract between User and Us;

  • The retention period required by current regulations (accounting obligations, archiving obligations);

  • The duration of User’s consent for certain uses;

  • For a maximum of 6 months for cookies;

  • When We no longer need to use User’sData, We delete it from Our systems and databases or anonymize it so that User is no longer identified.

Hosting, storage and transfer of User’s Data outside the European Union.

Due to Our presence in many countries around the world, certain Data may be collected, transferred, hosted and/or more generally processed outside User’s country of residence. Data protection and security requirements differ from one location to another and may not offer the same level of protection as those in User’s country of residence or origin. Nevertheless, We take adequate measures to protect the transfer of User’s Data. These measures include the use of data processing methods approved by the European Commission, and written agreements with Our subcontractors to ensure that they process the Data they receive on Our behalf, in accordance with applicable legislation.

We may, disclose User’s Data to third party partners in order, in particular, to ensure the maintenance and security of the Sites and Services, to offer certain functionalities, or to improve the Site and Service.

We require these third parties to provide sufficient guarantees of confidentiality and security and to take the physical, organizational and technical measures necessary to protect and secure User’s Data, in accordance with current legislation. Any data transfers outside the European Union are governed by the guarantee mechanisms validated by the European Commission or the competent local authorities.

Security measures

We implement appropriate organizational, physical, administrative and technical security measures to protect User’s Data in the best conditions against loss, theft, misuse, abuse, as well as against fraudulent access, disclosure, alteration and destruction. No data transmission over the Internet can be fully secure, but We undertake to implement industry-accepted security standards designed to protect User’s Data.

These measures include, but are not limited to:

  • Storage on secure servers within the European Union;

  • The protection, in particular via encryption processes of transmitted data;

  • Limited access to databases containing Data by Our employees or personnel of third parties;

User’s rights

If User resides in Europe he/she benefits from the RGPD As follows:

  • Right to information: right to obtain clear, transparent and comprehensible information on how We use User’s Personal Data ;

  • Right of access: right to access User’s Personal Data held by Us about User; Right of rectification: the right to have User’s Personal Data corrected if it is inaccurate or erroneous and/or to have it supplemented;

  • Right to erasure / right to be forgotten: right to request the erasure or deletion of User’s Personal Data. This right may, however, be limited by Us on the basis of a legal reason or legitimate interest in retaining said Personal Data. Such a request will result in the termination of the User's account, and the User will no longer be able to access the Sites or Services;

  • Right to object to direct marketing: Right to request or modify User’s choice at any time not to receive communications relating to offers of Services, Products, news or events from Us or third-party partners. In this case, User can use the hypertext link provided for this purpose in each e-mail or promotional communication received or the STOP SMS which appears in each promotional SMS received. User may also request to receive non-personalized communications about Products and Services. We will use Our best efforts to inform Our third-party partners of this, unless such information proves impossible or requires disproportionate effort. In this case, it will be up to User to contact the third party in question directly in order to ask them to unsubscribe / unsubscribe / or opt-out;

  • Right to withdraw consent at any time for data processing based on consent: right to withdraw User’s consent relating to the processing of his/her Personal Data when such processing is based on consent;

  • Right to data portability: right to request a copy or transfer of User’s Personal Data to another database. This right applies only to Personal Data supplied by User, and provided that the processing is based on a contract or consent and carried out using automated processes. We will then provide User with said Data in a structured manner and in a readable format.

Data security breach

In accordance with Articles 33, 34 and 55 of the GDPR, if We are the victim of or become aware of a breach of the security system, We will report it to the territorially competent authority and where required by law, We will inform User of the breach.

Cookies Policy

What are cookies and other trackers? Cookies or other similar identifiers are files deposited when a website, mobile application or online advertisement is consulted and stored in a specific space on the hard disk of the User's computer or mobile device.

Cookies enable status information to be sent when a User consults a site. Status information can be, for example, a session identifier, a language, an expiry date, a response domain, etc. Cookies are managed by the User's Internet browser or mobile application, and only the issuer of a cookie can decide whether to read or modify the information contained in it.

Cookies have several functions, such as enabling the User to navigate efficiently on a site or mobile application and/or to optimize its operation, to remember his choices, to offer him relevant advertising content according to his centers of interest expressed during navigation. There are different types of cookies:

  • Operating cookies, required to operate the Service

  • Cookies related to targeted advertising operations,

  • Certain audience measurement cookies.

The installation of cookies - other than Operating cookies - is subject to the User's consent. On the User's first visit to the site or application, an information banner is displayed, informing the User that by continuing to browse the site, he or she can choose which cookies will be installed on his or her equipment. The User must consent to the installation of certain cookies in order to continue browsing the site. If the User consents in accordance with the terms and conditions brought to SOL Distro's attention, he/she may at any time revoke his/her choice in accordance with the terms and conditions described in the paragraph below entitled "How to deactivate cookies".

SDKs (Software Development Kits) are programming tools offered to publishers and developers of mobile applications.

SDKs can have various functionalities. Some enable debugging or debugging of mobile applications. Others detect and analyze application crashes. Finally, some are used to analyze the audience and user behavior on applications in order to measure their popularity, or to serve advertising.

SOL Distro and its Service Providers use, if the User has consented, cookies and other technologies for various reasons. Cookies and other technologies enable SOL Distro, among other things, to authenticate the User, notably when he/she is connected to the website and/or the application in order to provide the service, to facilitate access to the Services (SOL Distro offers to remember the User each time he/she connects).

What cookies does SOL Distro use? Unless the User objects, the cookies used on the Service are :

  • Google Analytics

  • Intercom Support

  • AppsFlyer Analytics

How can I deactivate cookies? The User has several options for deleting cookies and other trackers:
Application settings: The registration of a cookie in the User's terminal is subject to his will, which he can express and modify at any time and free of charge through the choices offered to him by the software.

The User can – except for operating cookies necessary for the smooth running of the Service - choose to accept all cookies or reject them systematically, or choose which cookies to accept depending on who is sending them. The User may also configure the software to accept or reject cookies on a case-by-case basis, prior to their installation.

The User may also regularly delete cookies from his terminal via the software. The User must not forget to set the parameters on his various terminals (tablets, smartphones, computers, etc.).

Cookies enable the User to take full advantage of the Site's functionalities. If the software is configured to refuse all cookies or trackers, this may prevent the use of part of the Service, for which the Publisher cannot be held responsible. In order to manage cookies and trackers as closely as possible to the User's expectations, he/she is advised to configure the software according to its purpose.

How long do cookies last? Cookies are kept for a maximum of 13 months. At the end of this period, SOL Distro must again obtain the User's consent.
